Acceptance of these Terms
These Terms of Use (“Terms”) are a binding agreement between you and Left Middle News (“Left Middle,” “we,” “us,” or “our”) governing your access to and use of the leftmiddle.com website, the Left Middle News mobile apps for iOS and Android, and any related services (collectively, the “Services”). If you do not agree to these Terms, do not use the Services.
Who can use the Services
You must be at least 13 years old to use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
What we provide
Left Middle News is a news reader that aggregates headlines and links from third-party publishers and offers an editor-written Daily Briefing. We do not own the underlying articles. Headlines, summaries, and links are provided so you can read the full article on the publisher’s own website or app.
We may change, suspend, or discontinue any part of the Services at any time. We try to give reasonable notice for material changes.
Third-party content
Articles, images, video, and other content surfaced through the Services belong to their respective publishers and are governed by those publishers’ own terms and policies. We are not responsible for, and do not endorse, the accuracy, legality, or quality of third-party content. When you follow a link out of the Services, you are subject to the destination site’s terms.
Subscriptions and billing
Some features (collectively, “Left Middle Premium”) require a paid subscription. Subscriptions are sold and billed by Apple through the App Store on iOS and by Google through Google Play on Android, under their respective terms.
- Payment is charged to your App Store or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage and cancel your subscription in your App Store or Google Play account settings.
- Except where required by law, payments are non-refundable. Refund requests are handled by Apple or Google according to their refund policies.
Advertising
The free version of the Services may display advertisements, including ads served by third parties such as Google AdMob. Ads are subject to the policies of the ad network displaying them. We do not control and are not responsible for the content of third-party ads.
Your account and conduct
You are responsible for your use of the Services. You agree not to:
- Use the Services in violation of any law or third-party right.
- Reproduce, redistribute, scrape, or commercially exploit any part of the Services or the third-party content surfaced through them, except as expressly permitted.
- Reverse engineer, decompile, or attempt to derive the source code of the Services, except where this restriction is prohibited by law.
- Interfere with the Services, our servers, or other users (including by attempting to bypass rate limits, security controls, or paywalls).
- Use the Services to transmit malware, harassment, or unlawful material.
Our intellectual property
The Left Middle name, logo, Daily Briefing editorial content, app design, and the original portions of the Services are owned by Left Middle News and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes, subject to these Terms.
Feedback
If you send us suggestions or feedback, you grant us a non-exclusive, perpetual, royalty-free license to use them for any purpose without any obligation to you.
Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE, COMPLETE, OR TIMELY.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LEFT MIDDLE AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.
Indemnification
You agree to defend, indemnify, and hold harmless Left Middle and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.
Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including if we reasonably believe you have violated these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.
Apple App Store terms
If you use the iOS app, you acknowledge that these Terms are between you and Left Middle, not Apple, and that Apple has no obligation to provide maintenance or support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you. You agree to comply with the Apple Media Services Terms and Conditions and represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country.
Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws principles. The state and federal courts located in [STATE] will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction in those courts. Nothing in this section limits any rights you may have under the consumer-protection laws of your country of residence.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Effective” date above and may provide additional notice through the Services. Continued use of the Services after a change means you accept the updated Terms.
